The issue of the non-fulfilment of suspensive conditions was again confirmed in Ashington & Another v Body Corporate of Dryden Hall & Another [2009] JOL 23405 (D) as rendering an agreement a nullity. Where there are multiple suspensive conditions set out separately in an agreement non-fulfilment of only one of them will have the same effect.
